Article 1

These general terms and conditions apply and are valid as soon as the buyer sends their order online. By placing an order, the buyer acknowledges that they accept these general terms and conditions of sale.

Quality and ethics

All our products are formulated without recourse to animal testing.

Article 4

Bio-Gestion SA/Gelaform.com complies with the code of ethics for distance selling, which aims to provide better consumer protection. The reputation we have earned since 1983 is our greatest pride and our most valuable asset.

GUARANTEE and LIABILITY

Right of withdrawal

You have a withdrawal period of 14 days from receipt of your order.

“Satisfied or refunded” guarantee

Bio-Gestion offers you an extended 3-month “Satisfied or refunded” guarantee. If, after 3 months of regular use of the product, you do not obtain the stated result, the price of the products will be refunded to you. The return costs set out below apply. A signed declaration stating that you have followed our recommendations on frequency and dosage to the letter will be required.

Return costs are borne by the customer. In addition, charges for inspecting the goods, disinfection (viruses), repackaging and restocking apply; these will be deducted from your refund at a rate of 20 € per return.

Returns:

Please note: before returning a parcel, you must contact us by telephone or by post. A return without prior contact cannot be accepted under any circumstances. Once Bio-Gestion SA has given its approval, you may proceed with the return. The parcel must be properly packed in its original box, carry sufficient postage and be accompanied by the invoice.

Use of your data:

In accordance with the Data Protection Act (Loi Informatique et Libertés) no. 78.17 of 16 January 1978, Art. 27, and the implementation of the GDPR of 25 May 2018, you have a right of access, rectification or objection to the use of your personal data by third parties. To exercise this right, simply send a written request stating your name and full contact details.

Prices

Article 5

Prices are shown in euros, including VAT. Packaging and delivery costs are charged in addition.

Article 6

In the event of an error in the price of a product, Bio-Gestion SA/Gelaform.com reserves the right to change this price, offering the customer the option of cancelling the order if the new price does not suit them.

Article 7

“Special offer” prices are strictly limited in time.

Shipping

Article 8

Except where an item is out of stock, orders are generally fulfilled within 7 days of receipt of payment.

Article 9

Under Article 185 of the Swiss Code of Obligations, Bio-Gestion SA/Gelaform.com is no longer responsible for the parcel once it has been handed over to the post office for dispatch. In the event of suspected theft, loss of goods or a damaged parcel, Bio-Gestion SA/Gelaform.com cannot be held responsible and shall not be obliged to make a refund.

Payment

Article 10

“Online” orders must be paid in advance. Payments are secure: we accept Visa, Mastercard, American Express, UnionPay and Bancontact cards, as well as Apple Pay and Google Pay.

Article 11

The buyer’s final click, by which the order is confirmed and sent, constitutes an electronic signature. This has the same validity as a handwritten signature and means that the transaction has been accepted by both parties within the framework of the offer and the general terms and conditions of Bio-Gestion SA/Gelaform.com

Validity of the offer

Article 12

The offers made by Gelaform.com are valid only while stocks last. Bio-Gestion SA/Gelaform.com cannot be held responsible for any product that can no longer be delivered, is out of stock or is sold out. If the product ordered is unavailable, the buyer will be informed and will have the option of cancelling the order.

Article 13

Bio-Gestion SA/Gelaform.com reserves the right to modify and replace products according to the availability of its suppliers, without any change in price, provided that the product is equivalent.

The images shown on the site are not contractually binding.

Complaints and returns of goods

Article 15

Complaints must be made by telephone or e-mail no later than 48 working hours after receipt of the goods. Before returning a parcel, the buyer must inform us by telephone. A return without a prior telephone call cannot be accepted under any circumstances. We accept returns of goods within the legal period of 14 days, provided that the packaging has not been opened, and only in the following cases:

The products received do not correspond to the order; the packaging arrived damaged at the buyer’s address.

Warranty and liability

Article 16

The warranty offered by Bio-Gestion SA/Gelaform.com corresponds to that of its suppliers. The liability of Bio-Gestion SA/Gelaform.com is limited exclusively to the replacement of defective products. Bio-Gestion SA/Gelaform.com accepts no liability whatsoever if delivery is impossible or delayed owing to an incorrect delivery address, the absence of the recipient, customs (export) problems or events of force majeure.

Miscellaneous

Article 17

For any case not covered by these general terms and conditions of sale, the Swiss Code of Obligations shall prevail.

Place of jurisdiction

Article 18

In the event of a dispute, the competent place of jurisdiction is Nyon (canton of Vaud, Switzerland).
